These Terms of Use define the rules for using the Givenly service, accessible via the website givenly.io and the web application app.givenly.io.

Givenly is a service for organizing gift exchanges between individuals (Secret Santa, random draws, wishlists, etc.).

Using the service implies full and complete acceptance of these Terms of Use. If you do not accept these terms, please do not use the service.

Givenly reserves the right to modify these Terms at any time. Users will be notified of any changes.

To fully use the service, you must create an account by providing accurate and complete information.

• You are responsible for the confidentiality of your credentials
• You must be at least 13 years old to create an account
• Only one account per person is allowed
• You agree not to impersonate another person

You agree to use the service in accordance with these Terms and applicable laws.

It is prohibited to:

• Use the service for illegal or fraudulent purposes
• Collect personal data from other users without consent
• Publish offensive, defamatory or unlawful content
• Disrupt the proper functioning of the service
• Circumvent the service's security measures

The service uses analytics tools (Google Analytics, PostHog) to improve the user experience. These tools are only activated after your explicit consent via the cookie banner (Axeptio). For more details, see our privacy policy.

Givenly offers a free plan with the following limits:

• Christmas groups: 3 groups maximum
• Gifts: 10 gifts maximum per wishlist
• Secret Santa: 2 draws maximum

A subscription system may be offered in the future to lift these limitations and access unlimited features. Pricing conditions will be communicated before any subscription.

The Givenly service and all its elements (logo, design, code, features) are the exclusive property of Givenly.

You retain ownership of the content you publish, but grant Givenly a license to use it within the scope of the service.

Givenly strives to ensure the availability and reliability of the service, but cannot guarantee uninterrupted operation.

Givenly cannot be held liable for indirect damages resulting from the use of the service.

You can delete your account at any time from your profile settings.

Givenly reserves the right to suspend or delete an account in case of violation of these Terms.

These Terms are governed by French law. In case of dispute, French courts shall have exclusive jurisdiction.
